Nick Viall - Bachelorette 10 Contestant - Plane Vid - Discussion - *Spoilers*

And I agree that Nick didn't say horrible things about Josh or Andi in the context of just having been dumped and thinking he had been duped as well.  But in the context of playing along with a foiler where he is just adding insult to Josh's injury, for me that's a totally different story, and not a very gracious one.

If the vid is a foiler, we are assuming/speculating that Andi knew about it. That may not be the case. She may have not known anything about it.

Honestly, I don't get it, while we're arguing who is going to sue who for what reason, this woman is Andi's bestie boo who is saying these things. I guess if it's all a foiler then Andi must be mad at her fiance or venting some frustrations to Kelly if this is Kelly's interpretation of him?

Most likely there is a clause that protects ABC and the production company from any acts of the other participants and holds them harmless.

More importantly, while anyone can sue, proving the statements false is a different matter.  In most states, a successful suit would have to prove that the person who defamed did so with malice and intent.  As long as the person who defamed could prove that he made the statements in good faith and had reasonable cause to think they were true, it would be hard to prove defamation.  The other issue would be determining damages.  I think the courts would find that Nick was offering his opinion.

The issue with an employee is completely different.  Most employee suits over these kinds of issues are for hostile work environment as opposed to defamation.

My only caveat to what you are saying ironcat, is if all along Josh and the Murrays realized that if not chosen by MeAndI he would be there next lead, I don't see him being all that heart broken.  All Nick said was pretty tame and in my opinion in no way would take away from interest in him being the bachelor.

Don't care if the video is real or foiler, but if the video is foiler, then Josh is the next bachelor (I would be shocked if he wasn't) and maybe that is a good thing.  Women who trust him and don't care if he was an athlete or not and they might need to try a little more blond and blue eyes in that gene pool.

For this scenario to make sense, one has to assume that Josh wasn't really into Andi in the first place and was just "faking it".  I know things happen quickly once out of the bubble, but still, if you think you're truly in love and want to marry someone one day, you don't get over being rejected by the next and ready to sign on to be The Bachelor, which is pretty much the time frame we're talking about here.  And technically, Josh wouldn't have even made it out of the bubble by the time he would have had to sign on to the whole "foiler".

But I do agree that what Nick said wouldn't reflect badly on Josh or lessen fans' interest in him possibly being the next lead; if it reflects badly on anyone in the fans' eyes, it's Nick himself.
