Contrary to popular belief and TV shows the police don't like to bust into someone's home and arrest them. It can be dangerous for the police and for anyone in the home. It can also lead to claims of abuse of force and police misconduct etc. My speculation is that the police knew who Chris was, didn't feel he was a danger to himself, didn't feel he was a flight risk and JMO he was probably going to refuse the breathalyzer anyway. Better for the case to just wait until you have the legal piece of paper all nice and tidy. Which plays into the point I was trying to make about the bold. IA they have a job to do. My point was that this isn't Joe Schmoe. This is Chris Soules who does have at least a D grade celebrity status. Lots of people are watching not only Chris but the investigation also. The investigators don't want to look incompetent at any time but certainly not on a case that's being watched by millions of people and is going to be reported about in many papers, internet sites and magazines. Better for the investigator's to cross all the t's and not leave any room for doubt. JMOAA
How do you know this? I can't for one second think the police aren't going to break down someone's door if they need to and if legally they can whether it's CS or anyone else. There have been statements made how difficult it was to get information because CS didn't open the door and the time it took to get a search warrant. They had to take that route of obtaining a search warrant to arrest him because this wasn't a drug bust where he could dispose of the drugs, or there was a threat to any other individual in that home where the police would have the right to break in. IMO they would have arrested him whether they broke the door down or not regardless of who he is. IMO they would have wanted the breathalyzer test asap, therefore, legally if they were able to get in the house, they would have, regardless of who it is and not because they are afraid of police misconduct.
If that's the case you're saying for any Joe Shmoe it won't matter, they'll knock down that door because no one cares about him and he's not popular? Sorry, but I have to totally disagree with this. CS IMO isn't getting some preferential treatment.

With regard to the above, and I am not criminal lawyer, it is my understanding based on a U.S. Supreme Court decision of a few years ago that unless a emergency situation or exigent circumstances exist, (both of which you described above @GuardianAngel) the police cannot enter your home and arrest you without a warrant.

They could not enter with out the search warrant or Chris giving consent. It's sort of our 4th amendment rights. As always there are exceptions but wouldn't apply here.

This makes me rather angry. There is an at-fault fatal accident here. Chris needs to face the appropriate charges. JMHO based on many years in the insurance business.

They haven't been dropped yet just trying to get them dropped. It will be interesting what happens. My gut agrees with you.

Really? Was the tractor in compliance when rear ended? Was this proven by a court of law? I missed it.
I guess what I am saying is all the facts will have to come out.
Not just the facts on one side. The facts on both sides. That is what the laws and justice are based on in the USA (I believe, still). People are innocent until proven guilty in our society. That is proven guilty in a court of law. Not court of BBF or any other court of media etc. Thanks.

I agree with you but tractor compliance and leaving the scene are two separate issues. Which is why I am leaving it at it will be interesting what happens. My gut tells me he was wrong leaving but I have no clue how that plays out in court. It's a wait and see.

I'm with Kasha on this. We don't know if anyone was at fault or who if there was someone. Chris has only been charged with leaving the scene as far as I know. I suspect that his lawyers will argue that he did everything he was supposed to do, including calling 911 to report the accident, giving his name, and (apparently) giving aid to the tractor driver. I doubt it will be dismissed at this time. JMO
