Heck I hope that I'm never in a wreck and I'm coming home from grocery shopping and have wine in the car and people assume that I'm drinking just because it's in the car.

That's not the problem, but rather is it open, which is illegal.

I would never assume it was open but much of the reporting has hinted at that. I will wait until known to judge, but if it was a closed case of beer its not an issue.  If there are open cans in the truck that is an issue.

Open container is against the law in Iowa. If they were open I think he would have been charged.

I didn't know they add more charges after you are arrested and see a judge

Yes they can add charges based on the investigation results. This is just the first one they could get him on for sure.
